Personal Injury: Stressing the point

Here's a controversial claim - Psychiatric claims are probably the most divisive kind of claim in personal injury litigation. Writing in Legal Week, David Platt gives his view on recent judgments seen in this controversial area of personal injury litigation.

"On one hand, their supporters view the recoverability of such claims as an acknowledgement of the breadth and humanity of the common law, denying any distinction between physical and mental injury. They believe tortfeasors and employers should pay for the consequences of their actions, rather than be deflected by oldfashioned views over what used to be termed ‘moral fibre’ — or so the argument goes. And on the other hand, detractors regard the way in which psychiatric claims have played out as the worst example of the compensation culture in practice. Council saves tax payers millions in compensation claim payouts Hundreds of people attempting to make a compensation claim against Glasgow council have had their claims rejected in a crackdown against spurious claimants.

In the last few years the council has seen a sharp rise in the number of personal injury claims against land services (roads), receiving around 1000 claims in the two years leading up to March 2005. Doubting the legitimacy of all of these claims the council has adopted a ‘firmer, but fairer’ approach, which it believes will save tax pays millions of pounds in payouts.

It has appointed a specially trained claims handling team in its risk management, insurance and claims section, who are applying new evaluation methods with improved inspection systems and more detailed investigations. About 80% of all injury claims are now rejected

Personal Injury Law Firm Relocates from New Orleans

The New Orleans law firm Gainsburgh, Benjamin, David, Meunier & Warshauer LLC announced it has temporarily relocated, with full professional staff, to New Roads, La.

Partner Robert J. David said that the firm will occupy temporary offices in New Roads until such time as it is possible to move back to their premises in downtown New Orleans.
